Contract of Carriage
This Contract of Carriage governs the terms and conditions of air transportation provided by Freight Runners Express, Inc. dba A.C.E. (Air Charter Express) (hereinafter referred to as "Carrier"). By purchasing or accepting air transportation, you ("Passenger") agree to these terms and conditions. This contract is in addition to the Operator-Participant Contract issued by Christian A Diaz Global Inc. dba Signature Pet Transport & PetAirX (hereinafter referred to as "Operator").
1. Definitions
Carrier: Refers to Freight Runners Express, Inc. dba A.C.E. (Air Charter Express), the air carrier performing the flight.
Operator: Refers to Christian A Diaz Global Inc. dba Signature Pet Transport & PetAirX, the company responsible for arranging the Charter.
Passenger: Any person holding a confirmed reservation with the Carrier and any animal being transported under the Passenger’s care.
Ticket: The electronic confirmation of transportation issued by the Operator.
Flight: Any air transportation service provided by the Carrier as described in the Passenger’s itinerary.
Baggage: All personal items and pet carriers accompanying the Passenger, including checked and carry-on items.
2. General Terms
By accepting a reservation or purchasing air transportation, you agree to abide by the terms set forth in this Contract of Carriage. The Carrier reserves the right to refuse transportation to any person who does not comply with the terms of this agreement, the Operator-Participant Contract, or any applicable laws or regulations.
3. Carrier Responsibility
The Carrier is responsible for providing the air transportation services outlined in the Passenger’s reservation. All flights are subject to change based on operational, safety, or regulatory requirements. The Carrier will use reasonable efforts to transport Passengers and their baggage according to the schedule provided, but schedules are subject to change without notice, and the Carrier assumes no liability for schedule changes, delays, or cancellations except as required by law.
4. Check-in and Boarding Requirements
Passengers must check in at least 60 minutes prior to the scheduled departure time. Failure to check in within this timeframe may result in denied boarding. All Passengers must present a valid government-issued photo ID that matches the Passenger’s name on the reservation.
5. Baggage
a. Carry-on and Checked Baggage:
Passengers may bring carry-on baggage and checked baggage as specified in their reservation. The Carrier reserves the right to refuse any baggage that does not comply with size, weight, or safety restrictions.
Pet carriers count as carry-on baggage. Each pet carrier must comply with the Carrier’s size and safety requirements.
b. Liability:
The Carrier’s liability for lost, damaged, or delayed baggage is limited to the extent permitted by applicable law. The Carrier assumes no responsibility for fragile or valuable items unless specifically declared and agreed to in advance. Any claim for baggage damage or loss must be submitted to the Carrier within 24 hours of the flight’s conclusion.
6. Prohibited Items and Hazardous Materials
a. What Can I Bring?
Certain items are prohibited by the TSA aboard passenger aircraft. For more information, see the TSA’s “Security Screening” page.
b. Hazardous Materials
Federal law forbids the carriage of hazardous materials aboard aircraft, in your luggage, or on your person. Hazardous materials include (but are not limited to) explosives, compressed gasses, flammable liquids and solids, oxidizers, poisons, corrosives, and radioactive materials. c. Hoverboards
The Carrier will not accept hoverboards (motorized, two-wheel, skateboard-sized scooters) aboard its passenger aircraft in either checked or carry-on baggage. Although government agencies have not prohibited the carriage of hoverboards aboard aircraft, the Carrier has prohibited these items due to the risk of fire from lithium or lithium-ion batteries contained inside. On rare occasions, these batteries can spontaneously overheat and pose a fire hazard risk.
d. Smart Bags / Smart Clothing
The Carrier prohibits smart bags, smart clothing, and other articles containing non-removable lithium batteries in checked or carry-on baggage.
e. Lithium Batteries
The Carrier will accept lithium ion or lithium metal batteries aboard passenger aircraft, provided they are properly installed in a permitted consumer electronic device. Spare or loose lithium batteries are not permitted in checked or carry-on baggage, and are only permitted as part of your personal item allowance.
7. Pets
a. Pet Travel Requirements:
Passengers must travel with, and have immediate access to, a muzzle suitable for their dog(s) at all times. The muzzle will need to be shown at check-in and must be worn by the dog(s) if requested by a representative of either Carrier or Operator or by the flight crew, whether before boarding or in-flight.
Dogs must always be on a leash at all times, including within the airport terminal and onboard the aircraft.
Cats must remain in their carriers at all times.
All pets must comply with local and international health and vaccination requirements. The Carrier assumes no responsibility for Passengers’ failure to comply with pet documentation requirements.
b. Liability:
You are responsible for and shall indemnify and hold harmless the Carrier, its personnel and representatives, and/or other flight passengers for any injury, death, property damage, and other losses caused by you or any animal you transport on a flight. The Carrier assumes no liability for injury, loss, or death of a pet unless caused by the Carrier’s gross negligence.
8. Refusal of Transportation
The Carrier reserves the right to refuse transportation to any Passenger or pet if:
The Passenger appears intoxicated or under the influence of drugs.
The Passenger fails to comply with check-in, documentation, or safety requirements.
The Passenger fails to follow crew member instructions.
The pet displays aggressive or disruptive behavior.
No refund will be provided in cases where transportation is refused for these reasons.
9. Cancellations, Delays, and Schedule Changes
The Carrier reserves the right to cancel, delay, or reschedule any flight due to operational, safety, or weather-related concerns. The Carrier’s liability for cancellations and delays is limited to refunding the portion of the fare applicable to the canceled or delayed segment. The Carrier is not liable for any consequential damages, including hotel, meal, or other travel costs.
In the event of a delay or cancellation, the Carrier will make reasonable efforts to notify Passengers and provide an alternative transportation solution.
10. Force Majeure
The Carrier shall have no liability for failure to operate or for delays resulting from circumstances beyond its control, including but not limited to acts of God, weather events, labor strikes, government restrictions, civil unrest, or other Force Majeure events.
11. Passenger Conduct
All Passengers must adhere to the instructions provided by the Carrier's crew members and comply with all laws and regulations regarding air travel. Disruptive or unsafe behavior may result in removal from the flight, and the Passenger may be subject to legal action.
12. Refunds
Refunds for unused tickets will be provided only as specified in the Operator-Participant Contract and are subject to the terms agreed to at the time of purchase. No refunds will be provided for cancellations or "no shows" by the Passenger unless specified otherwise.
13. Liability Limitations
The Carrier's liability is limited to the terms of this Contract of Carriage and the applicable laws. The Carrier shall not be liable for any consequential, indirect, or incidental damages, including lost profits, emotional distress, or punitive damages, unless expressly permitted by law.
The Carrier’s liability for injury, death, or property damage will be governed by the Montreal Convention or the Warsaw Convention, as applicable, and any limitations therein.
14. International Travel
For flights traveling internationally, the Montreal Convention or the Warsaw Convention, as applicable, shall apply. These conventions limit the Carrier’s liability in cases of injury, death, baggage loss, or delay.
15. Governing Law
This Contract of Carriage is governed by the laws of the State of California. Any disputes arising out of this contract will be subject to the exclusive jurisdiction of the courts located in San Diego County, California, unless governed by applicable international treaties.
This Contract of Carriage contains the entire agreement between the Carrier and Passenger and supersedes all prior agreements or representations. The Carrier reserves the right to amend or modify this contract at any time, and such amendments will be binding on all future travel.
