OPERATOR-PARTICIPANT AGREEMENT

This Operator-Participant Contract ("Agreement") sets forth the terms and conditions under which Christian A Diaz Global Inc. dba Signature Pet Transport ("SPT"), a Public Charter Operator (PC-24-104) under Part 380 of the U.S. Department of Transportation's regulations (14 CFR Part 380), with its principal place of business at 302 Washington St. Suite 934, San Diego, CA 92103, agrees to provide you ("Participant") with charter air transportation ("Charter") in return for payment in the amount indicated as the total Charter price.

For marketing purposes, SPT may also operate under the name "PetAirX". All references to SPT in this Agreement, unless otherwise noted, include any services marketed under the PetAirX name. This Agreement is in addition to the Contract of Carriage between Participant and Carrier, which sets forth the terms and conditions under which passengers and their baggage are carried on Charter flights, and establishes a separate contract between the Participant and the Carrier.

By purchasing a Charter seat, you agree to these terms and conditions.

1. Charter Services

a. Scope of Services:

SPT will provide air transportation to the Participant as outlined in the itinerary provided by SPT. This itinerary may be communicated via email or by any other electronic method. The Charter will consist of the origin and destination cities, dates of travel, and the amount of the fare. Any changes to the itinerary will be communicated to the Participant and agreed upon before the flight.

b. Air Carriers and Aircraft:

The Charter will be performed using Saab 2000 aircraft with thirty (30) seats, operated by Freight Runners Express, Inc. dba A.C.E. (Air Charter Express) ("Carrier"), which is a direct air carrier certified by the Federal Aviation Administration to perform flights under 14 CFR Part 135. SPT reserves the right to change aircraft type, aircraft capacity, or the air carrier performing the Charter flight without notice. No refunds or compensation will be given for such changes unless explicitly required by law.

c. Flight Schedules:

SPT does not guarantee single-plane or non-stop service. If necessary, SPT will make reasonable efforts to provide substitute service at comparable departure times, subject to operational constraints.

2. Reservations and Payments

a. Reservation Process:

Reservations are made directly through SPT. Upon receipt of your reservation request, SPT will review the provided details, including travel documents (i.e., Government-issued photo identification) and pet details. If your reservation request is accepted, SPT will notify you via email that your payment has been received and that your reservation is confirmed.

b. Payment:

Unless and until full payment has been received, your reservation is not confirmed. Payments made by Credit Card and payments made by wire transfer are transmitted directly to SPT’s public charter depository (escrow) account at CrossFirst Bank, located at 11440 Tomahawk Creek Pkwy, Leawood, KS 66211.

c. Travel Documents:

SPT reserves the right to deny boarding if any required travel documentation is missing or incorrect. It is the Participant’s responsibility to ensure that all travel documents are current and comply with the applicable laws.

3. Cancellations

a. Cancellations by Participant:

IF YOU CANCEL OR CHANGE A CONFIRMED RESERVATION, OR IF YOU “NO SHOW” FOR A FLIGHT, YOUR RIGHT TO A REFUND IS LIMITED AS FOLLOWS:

  • All reservations are non-refundable, unless SPT notifies you by email that your reservation was not accepted.

  • If you cancel or change your reservation, no refund will be due.

  • If you “no show” for a flight, SPT will consider that a passenger cancellation, and no refund will be due.

If at the time of cancellation, the Participant provides a substitute participant utilizing the same itinerary, or if SPT provides the substitute, a full refund less an administrative fee (10% of the ticket price) will be provided. SPT will not provide a substitute participant unless all seats on the flight have been initially sold out. Refunds will be processed within fourteen (14) days from the date of cancellation.

b. Cancellations by SPT:

If SPT cancels a flight for reasons other than Force Majeure (defined below), the Participant will receive a full refund of the Charter price within fourteen (14) days. In cases where the cancellation occurs less than 28 days prior to departure due to Force Majeure, no refund will be provided unless physically impossible to perform the trip.

4. Force Majeure

SPT shall have no liability or responsibility for any failure or delay in the performance of its obligations under this Agreement due directly or indirectly to Force Majeure. Force Majeure refers to events, circumstances, or causes beyond reasonable control, including but not limited to:

  • Acts of God, natural disasters, floods, earthquakes;

  • Quarantine, epidemics, pandemics, crew sickness;

  • Terrorist attack, war, civil commotion, riots;

  • Compliance with government law, orders, regulations;

  • Adverse weather conditions, strikes, industrial action.

In the event a flight is canceled due to Force Majeure, SPT's sole obligation will be to refund any amounts paid by the Participant. SPT WILL NOT CANCEL A TRIP LESS THAN TWENTY-EIGHT (28) DAYS BEFORE DEPARTURE, EXCEPT FOR CIRCUMSTANCES THAT MAKE IT PHYSICALLY IMPOSSIBLE TO PERFORM THE TRIP.

5. Pet Safety and Travel Requirements

a. Pet Muzzle and Leash Requirements:

Passengers must travel with, and have immediate access to, a muzzle suitable for their dog(s) at all times. The muzzle will need to be presented at check-in and must be worn by the dog if requested by either an SPT representative or the flight crew, whether before boarding or in-flight.

Failure to comply with these safety instructions will result in denied boarding without refund.

  • Dogs must be leashed at all times within the airport terminal and onboard the aircraft.

  • Cats must remain in their carriers at all times.

b. Pet Documentation:

It is the full responsibility of the pet owner to ensure compliance with all required documentation for their pet’s travel. SPT may provide resources or refer participants to pet travel partners, but SPT shall not be liable for any failure to comply with documentation requirements. Failure to supply correct pet travel documentation will result in denied travel, and no refund will be due.

Participants agree to indemnify SPT for any loss, damage, or expense resulting from their failure to comply with any applicable laws regarding pet travel documentation.

6. Baggage and Cargo

Participants are responsible for ensuring that all personal baggage, pet carriers, and other cargo comply with the size, weight, and content restrictions imposed by SPT and the Carrier.

SPT is not liable for any damage, loss, or delay in the delivery of baggage, except as required by applicable law.

7. Liability and Limitations

SPT’s liability for damages, delays, or cancellations is limited to the Charter price paid by the Participant. SPT SHALL NOT BE LIABLE FOR CONSEQUENTIAL DAMAGES, LOST PROFITS, OR INCIDENTAL DAMAGES, except where required by applicable law.

SPT recommends that Participants purchase trip insurance, health insurance, and pet insurance to protect against unforeseen circumstances, cancellations, or health issues.

8. Dispute Resolution and Governing Law

This Agreement shall be governed by and construed in accordance with the laws of the State of California, without regard to conflicts of law principles. Any disputes arising out of or in connection with this Agreement shall be settled through mediation or arbitration in San Diego County, California, unless otherwise mutually agreed upon by the parties.

9. Responsibility

Christian A Diaz Global Inc. dba Signature Pet Transport ("SPT") is the principal and is responsible for making arrangements to provide the services included in the Charter. In all cases, transportation is subject to all the terms and conditions of the respective carrier’s applicable tariff and/or Contract of Carriage. In the case of scheduled airline service, refer to the air transportation ticket for conditions of carriage and notice of incorporated terms, and inquire with the airline for additional details. Airlines and other travel suppliers are independent contractors and are not agents or employees of SPT. Accordingly, you agree that, except as otherwise provided herein, SPT is not responsible or liable for any loss, injury, expense, damage to property, personal sickness, injury, or death to you or any animal you transport on a flight that results directly or indirectly from (a) an act or omission of any air carrier or other travel supplier or (b) any other cause or act beyond the direct and immediate control of SPT.

You are responsible for any damage to the aircraft caused by you or any animal you transport on a flight, and you agree to indemnify and hold harmless SPT from any such damage. Except as otherwise specified herein, in the event of non-operation of any flight due to reasons beyond the control of SPT, SPT’s sole liability shall be to refund to you that portion of the price allocable to the services not provided. Any deviation from the trip initiated by you is solely your responsibility. 

SPT shall not be liable for any damage, loss, expense, or other irregularity caused by defects in any vehicle or conveyance or the acts, omissions, or negligence of any air carrier or other third party engaged in conveying the Participant or carrying out the arrangements for any trip.

Any flight may be governed by the International Convention for the Unification of Certain Rules Relating to International Carriage by Air as amended (the “Warsaw Convention”) and/or the rules and regulations established by the Montreal Convention on the Unification of Certain Rules for International Carriage signed in Montreal on May 28, 1999 (the “Montreal Convention”). These rules and limitations shall apply to any flight(s) conducted by the air carrier to the extent that the Warsaw Convention and/or the Montreal Convention is applicable.

10. Identification and Travel Documents

Upon booking, you must submit a copy of your government-issued photo identification, which must match the passenger manifest. This identification must be brought with you on the day of travel. Failure to provide the correct identification may result in delayed departure or denial of boarding. SPT is not liable for any damage, loss, expense, or other irregularity caused by your failure to provide the correct identification and travel documents.

You are responsible for obtaining all necessary travel documents (passport, visa, tourist card, immunization certificate, and any other required documents) and for complying with the laws of each country from, through, or to which you are transported. SPT shall not be liable for any failure on your part to obtain the necessary travel documents. You agree to indemnify SPT for any loss, damage, or expense suffered or incurred by reason of your failure to comply with this section.

11. Release to Use Picture and Voice

By agreeing to this contract, you (“Passenger”) grant Christian A Diaz Global Inc. dba Signature Pet Transport and PetAirX, its affiliates, licensees, successors, and assigns, permission to use your picture (including photos, videos, and electronic images), voice (including audio and video recordings), and any written or spoken statements made during your travel with us.

You authorize us to use, reproduce, and publish your name, image, and voice for promotional, advertising, or marketing purposes in any media, including television, online platforms, print, and other formats, whether in the U.S. or internationally. This permission is granted indefinitely.

You also transfer any rights, title, and interest in all media captured (photos, videos, audio recordings, etc.) to Signature Pet Transport and PetAirX, allowing us to use, sell, distribute, or display these materials at our discretion. You waive the right to receive payment for these uses and any future uses of your image, voice, or statements.

Additionally, you waive the right to review or approve any finished materials (photos, videos, recordings, etc.) before they are used.

12. Online Acceptance

Acceptance of this Agreement through our website is an acceptable form of agreement. This Agreement contains the entire agreement between the parties and it completely supersedes any prior written or oral agreements or representations. No reservation will be issued unless the Participant accepts this Agreement.

For telephone sales where the Participant pays by credit card, SPT will send a copy of this Agreement by e-mail within 24 hours of accepting payment. The Participant must accept this Agreement prior to travel. Should the Participant decide not to participate in the Charter after reviewing this Agreement, they are entitled to a full refund if they decline before travel.
